The Last Will and Testament of Elisha Reace

            I Elisha Reace of the County of Crittenden and state of Kentucky Considering the uncertainty of this mortal life and being of sound mind & memory do make this my last will and Testament Viz that I

            Commend my body to the grave and my spirit to God who gave it in hope of a certain Resurrection beyond the tomb.

            As Respects my temporal concerns or any property that I may be in possession of at my death I will and dispose of in the following manner Viz:  As to lands I will & bequeath to my only living son G. C. Reece the tract of land on which I now live containing two hundred acres together with its appurtenances Also my additional claim of one hundred & sixty acres lying North West & south of the tract on which I now live all of which two tracts of land shall be the property of the afcd. G. C. Reace at my death.

            My oldest Daughter Permealy Owens which I have already given (or to her husband Wm. Owens) four hundred Dollars & I give and bequeath to her Permealy Owens five Dollars at my Death which will be her proportionable part with what she has had.

  I also have one hundred acres of land lying North West of the lands I now live on Known by the name of the Anderson tract Which I give and bequeath to my grand daughter Presley Francis Reace & her mother Susan Ford Formerly the wife of my youngest son P. N. Reace Decd.  Now It is here to be understood that I give and bequeath the last named hundred acres of land to Presley Francis Reace her mother Susan Ford but not to be subject to the disposal of by her husband Horatio Ford, but for the exclusive benefit of the afcd Presley Francis Reace and her mother Susan Ford.

            I give and bequeath to my second daughter Lucinda Proctor now a widow four hundred Dollars after deducting the amount of Receipts now in my possession & also what I have yet have to pay.

            I give and bequeath to my daughter Fanny Wilborn four hundred Dollars after Reducting what I have paid to her husband Willis Wilborn which is one hundred & twenty three Dollars.

            I have given to my Daughter Mary Hodge & her husband John Hodge three hundred Dollars.  And I give & bequeath to their oldest child James Elisha Hodge One Hundred Dollars to be Retained for him untill a proper age according to law.

            My daughter Levinah Stone I give & bequeath four hundred Dollars at my death also, my daughter Nancy Husbands I give and bequeath four hundred Dollars at my departure.

            I have now in my possession four negroes Viz: Clod, Rosanden, Tom & Harreit which four negroes I will shall be valued by 3 disinterested men chosen by the county court and then sold or drawn for according to the valuation..among my heirs..and payment to be made to each one according to what is herein willed and bequeathed unto them.

            I also further will and bequeath unto my Granddaughter Presley Francis Reace two hundred Dollars and one bed bedsted & furniture which I now occupy myself the money to be Reserved in the hands of the Executors until she becomes of age.  I also will & greatly desire that the afcd negro girl named Harriet shall not be Removed from the limits of this county but that she shall be traded to some of my heirs living within its bounds.  A negro man now in my possession named Cyrus I will that he shall be set free at my death by complying with the law in Respect to free negroes.

            My family bible I give and bequeath to my son G. C. Reace.  And all the ballance of my books to be divided among my children.  And now the Remainder of property not named in this will that I may be in possession of at my death I will shall be sold at public sale by my Executor.  I further will that should any contest ever arise or law suit come against the title of the land I now live on that such contest or law suit shall be defended at the expense of my Estate.

            And finally should there be any money Remaining after each one of my heirs getting the portion alloted to them in this will & paying all expenses, I will that such Remainder shall be equally divided among my heirs.  And now I do hereby appoint G. C. Reace my sole Executor to manage all my business & every thing pertaining to my Estate of this my last will and Testament hereby revoking all former wills by me made.

            In witness whereof I have hereunto set my hand & seal this 16th day of April in the year of our Lord 1845.

Signed Sealed & declared by the above named Elisha Reace to be his last will & testament in presents of us who have hereunto subscribed our names as witnesses in the presents of the Testator.

            I H. W. Bigham clerk of the county court for said county hereby certify that at said term This last will and Testament of Elisha Reace Deceased was proven to be the last will and Testament of said Elisha Reace by the oaths of Robison Cole & J. J. Cole, two of the subscribing witnesses thereto and ordered to be Recorded.  Whereupon I have Recorded the same and this certificate in my office this 10th April 1848.
