Hodge Probate Records
Papers relating to the estate of Henry Hodge, who apparently died intestate on May 10, 1904, in Roby, Fisher County, Texas. No record has been found of his death, but these papers on file in the County Clerk’s office of Fisher County pertaining to the guardianship of his minor daughter Rosa, appear to confirm that the date and place of death obtained from the Texas Medical Association is probably correct. of April Term, A.D. 1905 To the Hon. J. D. Barker, Judge in Probate: Comes now Mrs. M. F. Hodge, and would respectfully show to the Court that Rosa May Hodge is a girl 16 years of age, and a minor residing in Fisher County, Texas. That said minor is possessed of an estate consisting of real estate situated in Fisher and other counties in the state of Texas of the probably value of $500.00, and that said minor has no guardian of her said estate. The said Mrs. M. F. Hodge, your petitioner, would further show that she is the mother of said minor and the natural guardian of her person and hereby makes application for letters of guardianship of the estate of said minor, Rosa May Hodge. Your petitioner would further show that she is a resident of said Fisher County Texas, and is not disqualified to act as the guardian of said estate and is a feme sole. You are hereby commanded to cause to be posted for ten days, exclusive of the day of posting before the return day hereof in three of the most public places in Fisher County, one of which shall be at the Court House door, and no two of which shall be in the same city or town, copies of the following notices. The State of Texas, To all persons interested in the welfare of Rosa May Hodges [sic] minor Mrs. M. F. Hodges has filed in the County Court of Fisher County an application for Letters of Guardianship upon the estate of said minor which will be heard at the next term of said court commencing on the First Monday in April A.D. 1905, the same being the 3rd day of April A.D. 1905 at the Court House thereof in Roby at which time all persons interested in the welfare of such minor may appear and contest said application if they see proper to do so. Herein fail not but have you before said Court on the said first day of the next term thereof this writ with your return thereof showing how you have executed the same. Witness D. T. No. 85 In the Matter of the Estate of Rosa May Hodge, minor April 5, 1905 On this day came on to be considered by the Court the application of Mrs. M. F. Hodge, a widow, for letters of guardianship of the estate of Rosa May Hodge a minor over 14 years of age and it appearing to the Court that notice of such application has been given by citation duly served as required by law, that the said Rosa May Hodge is a minor over 14 years of age, that this Court has jurisdiction of this case, that the said Mrs. M. F. Hodge is not disqualified to act as such guardian and that the said Rosa May Hodge minor has selected the said Mrs. M. F. Hodge as the guardian of her said estate by writing duly signed and filed with the papers of this cause, It is therefore ordered adjudged and decreed by the Court that the said Mrs. M. F. Hodge be and she is hereby appointed guardian of the estate of the said Minor Rosa May Hodge and her bond is hereby placed at $1000.00. It is further ordered that F. H. Parker, W. A. Weakley and M. A. Hopson be and they are hereby appointed as appraisers of said estate. The clerk of this court is hereby directed to issue letters of guardianship to the said Mrs. M. F. Texas In County Court Know all men by these presents: That we Mrs. M. F. Hodge, a feme sole as principal and W. A. Weakley and J. A. Barlow as sureties are held and firmly bound unto J. O. Barker County Judge of the County of Fisher and his successors in office, in the sum of one Thousand Dollars conditional that the above bound Mrs. M. F. Hodge who has been appointed by the County Court of Fisher County Guardian of the estate of Rosa May Hodge, a minor, will faithfully discharge the duties of Guardian of the Estate of the said minor according to law. No. 85 Inventory and Appraisement In Re Estate of Rosa May Hodge Minor April 22, 1905 Comes now Mrs. M. F. Hodge, guardian of the estate of Rosa May Hodge minor and returns to the Court an inventory of the Property, real and personal belonging to the estate of said ward that has come to her knowledge, which she has caused to be appraised, and she also attaches a list of the claims due and to become due to said estate. No. 85 In Re Estate of Rosa May Hodge Minor 22 April, 1905 On this day came on to be considered the report of appraisers, inventory and list of claims filed herein on the 22nd April, 1905, and the Court having examined the same carefully, and found it to be in compliance with law; it is therefore ordered adjudged and decreed by the Court that the said report, inventory and appraisement be and the same is hereby in all things approved. No. 85 In Re Estate of Rosa May Hodge Minor Comes now M. F. Hodge, guardian of the estate of Rosa May Hodge, minor, and respectfully shows to the Court that the estate of said ward has no income and that the personal property of said estate is notes all of which are long past due and apparently insolvent and that there has been no sales of any portion of said estate and your petitioner would also show to the Court that said personal property is insufficient for the education and maintenance of said ward, and hereby makes application for an order to be issued authorizing the sale of said ward’s undivided ½ interest in and to twenty acres of land in Brazoria County, Texas, being tracts No. 26 and 34 of the subdivision of section 25 originally granted to E. C. Lewis, assignee of Alexander Crane, Harris & Brooks; also for the sale of said ward’s interest in and to lots Nos. 13, 14 & 15 in Blk No. 85 in the town of Roby in Fisher County, Texas and lot No. 4 in Blk No. 72 in the said town of Roby as her interest may appear, as a necessity for such sales your applicant would respectfully show that said ward has no income from any source whatever, that the natural guardian of her person is altogether unable to furnish with support and maintenance and that said ward is, and will be until such property is sold, entirely dependent upon the charity of persons not bound legally for her support. Wherefore your petitioner prays for an order of sale of the above described property authorizing the sale thereof by private sale for cash or for part cash and part on credit as provided by law. M. Granted J. D. Barker, Judge No. 85 In Re Estate of Rosa May Hodge minor On this day came on to be heard in the
guardianship of Rosa May Hodge, a minor the application of Mrs. M. F. Hodge,
guardian of the estate of said minor for the sale of real estate belonging to
the estate of said minor and it appearing to the Court that citation has been
issued and served as required by law, and that it is more advantageous to said
estate to sell the land mentioned in said application to wit: an undivided one
half interest in and to 20 acres of land in Brazoria County, Texas, being tracts
Nos. 26 & 34 of the subdivision of section No. 25 originally granted to E. C.
Lewis assignee of Alexander, Crane, Harris & Brooks, also an undivided one half
interest in and to lots Nos. 13, 14 & 15 in block No. 85 and Lot No. 4 in block
No. 72 in the town of Roby, in Fisher County, Texas; and it further appearing to
the Court that said land ought to be sold for cash or for part on credit not to
exceed 12 months and all deferred payments to bear interest from date at a rate
not less than 6% per annum at private sale, and that it is necessary that said
land should be sold for the support and maintenance of said ward. It is
therefore ordered, adjudged and decreed by the court that said M. F. Hodge,
guardian as aforesaid, sell the above described tract or tracts of land,
separately or collectively, at private sale for not less than 1/3 cash and the
balance on credit of not exceeding twelve months secured as the law direct, and
that she make due report of such sale or sales at the next term of this Court
after such sales are made in accordance with law.
