Mobley Wills

 

Rezen Mobley’s will:

            In the name of God, Amen!  I, Rezen Mobley of this County of Coweta and State of Georgia, being of sound and disposing mind and memory and being desirous to settle my worldly affairs while I have strength so (to do do) make and publish this my last will and testament, hereby revoking all wills by me at any time heretofore made, and First, I commit my soul to God who gave it and my body I desire to be buried in the family burial ground at Macedonia Baptist Church in the County of Coweta and State of Georgia and my worldly estate I dispose of as follows:

            1st, I give and bequeath unto my wife Martha Ann Mobley all my real estate during her natural life or widowhood for her support consisting of lot of land no. (133) One hundred and thirty three in the original fifth District of Coweta County, Georgia containing (150) One hundred and fifty acres more or less.

            2nd, I desire that my horse remain on my farm for the first year after my death to make the crop with and if my debts can be paid without selling it, I desire my wife to keep my horse so long as she remains single or unmarried.  In case my wife should marry, then my horse is to be sold with my other property.  I desire my wife to have my cow and calf for her own use.  My stock of hogs, except one shoat which I give unto my wife, I desire to be sold and the proceeds applied to the payment of my debts.  My buggy and harness, I leave unto my wife, provided my debts can be paid without their sale.  I leave unto my wife one feather bed and bed clothing for the same.  I give unto my son Hezekiah Madison Mobley, one bedstead, feather bed, and bed clothing.  I desire one bedstead and bedding to be sold and the proceeds applied to the payment of my debts.  I desire at the death or marriage of my wife that my land be sold and the proceeds be divided as follows:

            I bequeath unto my granddaughter, Stevey Mobley ($200.00) Two Hundred Dollars.  I give unto my son Joseph S. Mobley, the balance of the proceeds of the sale of my land provided said balance does not exceed ($500.00) Five hundred dollars.  In case said balance does exceed ($500.00) Five hundred dollars, the excess over five hundred dollars I desire divided equally between my two sones Hezekiah M. Mobley and Joseph S. Mobley.

            I, the said Rezen Mobley do declare in the presence of these witnyses that the foregoing is my last will and testament test this 7th February 1877.

February Term 1883

Citation having been duly issued and published calling upon all parties interested to show cause at this term why permanent letters of administration with the will annexed on the Estate of Rezen Mobley, late of said county deceased should not be granted to Martha A. Mobley widow of said deceased and no cause having been shown to the contrary it is so ordered by the court thata said Martha A. Mobley be and she is hereby appointed administratrix with the will annexed on the Estate of said Rezen Mobley upon her taking and subscribing the oath and giving the bond required by law in the Sum of One thousand dollars.   J. I do solemnly swear that Rezen Mobley deceased died testate and that I will well and truly administor on all of the Estate of said deceased and disburse the same as the law requires and discharge to the best of my ability all my duties as administrator with the will annexed So help me God.

Sworn to and subscribed before me this 6th day of February 1883.
